(“New Relic”) invites all eligible participants to enter the New Relic New Sign Ups Holiday 2021 Giveaway (the “Giveaway”) which will be held from Monday, November 15, 2021 at 8:00am PT through Wednesday, December 15, 2021 at 11:59PM PT (the “Giveaway Period”). Participants may be eligible to win the prizes detailed below. Supplies limited.

Prizes:
- New Relic Data Nerd Swag Pack Giveaway: The first five hundred (500) eligible participants to ingest 2GB or more of data into their New Relic One free tier account will be contacted via the email address associated with their New Relic One free tier account sign up with a link to claim one (1) New Relic Data Nerd Swag Pack consisting of one (1) T-Shirt, one (1) sticker, one (1) pair of socks, one (1) drinking straw, and one (1) non-medical mask. Prizes are non-transferable and have an approximate prize value of $40 USD. Winners shall have fourteen (14) calendar days after receiving the email notification to claim their prize or else it will be forfeited.
Who Can Enter:
To enter the Giveaway, participants must have received an email from New Relic within seven (7) days of their New Relic One free tier account creation regarding their data ingest titled “***Limited Time Offer*** Claim your NerdSwag pack when you ingest by December 15” and their account must then ingest at least 2GB of data after receipt of that email and within the Giveaway Period. To sign up for the free tier of New Relic One, go to https://newrelic.com/signup and follow the sign-up instructions to create an account. The Giveaway is strictly limited to legal residents of the United States and Washington, D.C. who are at least eighteen (18) years of age. Each participant is solely responsible for ensuring that their participation in the Giveaway is lawful and that they have the authority to enter into the Giveaway personally or on behalf of the company or other organization the participant have named as the user on the New Relic account registration page. New Relic employees are not eligible to participate in the Giveaway. New Relic reserves the right, at its sole discretion, to disqualify participants for any reason, including if it is determined that one’s participation in the Giveaway is not lawful.

ALL PARTICIPANTS IN THE GIVEAWAY RELEASE NEW RELIC, INC. AND ITS RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AND SHAREHOLDERS (“RELEASED PARTIES”) FROM AND AGAINST ALL LIABILITY, CLAIMS, AND DAMAGES ARISING IN CONNECTION WITH THEIR PARTICIPATION OR INABILITY TO PARTICIPATE, ENTRY IN THE GIVEAWAY AND/OR ACCEPTANCE, RECEIPT, OWNERSHIP OR USE OF THE PRIZE AWARDED IN THE GIVEAWAY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY OR LOSS OF PROPERTY. BEFORE CLAIMING THEIR PRIZE, THE WINNER MUST EXECUTE AN AFFIDAVIT AND WAIVER VERIFYING THEIR ELIGIBILITY AND ACKNOWLEDGING (i) THEIR RESPONSIBILITY FOR ANY TAXES INCURRED IN CONNECTION WITH THE PRIZE AWARDED AND (ii) THAT NEW RELIC WILL NOT BE LIABLE FOR ANY INJURIES CAUSED WHILE OPERATING PRIZES AWARDED FROM THE GIVEAWAY.

RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY CLAIMS, DAMAGES, EXPENSES, COSTS OR LOSSES TO ANY PERSON OR PROPERTY OF ANY KIND ARISING FROM OR IN CONNECTION WITH (1) TYPOGRAPHICAL OR OTHER ERRORS IN THE PRINTING OF THESE OFFICIAL RULES; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS OR DISCONNECTIONS OR DISCONNECTIONS IN PHONE LINES, HARDWARE, SOFTWARE OR FAILURE OF ANY EMAIL OR ENTRIES TO BE RECEIVED BY NEW RELIC DUE TO TECHNICAL PROBLEMS, HUMAN ERROR OR TRAFFIC CONGESTION, UNAVAILABLE NETWORK CONNECTIONS ON THE INTERNET OR ANY WEBSITE; (3) UNAUTHORIZED THIRD PARTY TAMPERING WITH THE GIVEAWAY; (4) TECHNICAL OR HUMAN ERROR IN THE ADMINISTRATION OF THE PRIZE; OR (5) LATE, LOST, UNDELIVERABLE, DAMAGED OR STOLEN MAIL.
General:
Any entries generated by a script, computer program, robotic or other automatic means will be disqualified.
The Giveaway is governed by and will be construed in accordance with the laws of the State of California and the forum and venue for any dispute shall be San Francisco, California.
Participants acknowledge that any contact information collected during the Giveaway Period will be used for marketing and other internal purposes. New Relic reserves the right to terminate this Giveaway for any or no reason and at any time without further notice.
