These Service Specific Terms (“Terms”) govern your use of the identified services below and are in addition to your agreement with New Relic for the Services (“Agreement”). Capitalized terms used but not defined in these Terms will have the respective meanings assigned to them in the Agreement.  New Relic may modify these Terms from time to time as our business changes and technology evolves. The most current version of these Terms will be posted on newrelic.com/termsandconditions/terms. If you do not agree to these Terms or any change(s) thereto, your sole remedy is to stop using the Service(s) below. Use of these Service(s) after any update shall constitute acceptance of these Terms. In the event of any conflict or inconsistency between these Terms and your Agreement, these Terms take precedence.

 

1.  Pre-releases

1.1. Your access and use of software, services, features, user-interfaces, and platforms made available to you by New Relic that are not yet generally available (including, alpha, beta, pilot, limited release, developer preview, technology preview, non-production, evaluation, or by a similar description) versions of a Service and Software are subject to the Pre-Release Policy in the Documentation.

 

2.  CodeStream

2.1. Definitions. 

“CodeStream Service” means New Relic’s proprietary cloud deployment of CodeStream and is considered a “Service”. The CodeStream Service includes the Documentation and Plugins, but not Third Party Services.

“CodeStream Data” means any data, content or materials that Customer submits to the CodeStream Service and is considered “Customer Data” with respect to the CodeStream Service.

“Plugins” means any on-premises software that New Relic provides to Customer as part of the CodeStream Service and is considered “Software.”

2.2. Third-Party Open Source.  The Plugins may incorporate OSS as listed in the Documentation, and such OSS is governed solely by the applicable OSS license.

2.3. Usage Limits.  When using the CodeStream Service, Customer will comply with the Documentation and any other instructions provided by New Relic from time to time, including the usage limits specified by New Relic (“Usage Limits”). Customer will not (and will not permit anyone else to) do any of the following: resell the Plugins to a third-party or redistribute the Plugins to a third-party except as expressly permitted by the applicable software license.

2.4. Termination of an Order.  Applicable Terms. If you are a paying New Relic One pricing customer, then your use of CodeStream is governed by the Agreement.  Otherwise, your use of CodeStream and your applicable data processing agreement for personal data in CodeStream are subject to https://newrelic.com/termsandconditions/unpaid. Upon termination of an Order, if any, Customer may continue to use the CodeStream Service subject to https://newrelic.com/termsandconditions/unpaid.

 

3.  Vulnerability Management

3.1. Disclaimer.  Assessing any security is a complex task. VULNERABILITY MANAGEMENT DOES NOT GUARANTEE THAT IT OR THESE SCANS, FINDINGS, TESTINGS, PREVENTIONS, MITIGATIONS, POTENTIAL REMEDIATION PATHS, OR THE LIKE WILL BE FREE OF ERROR, DISCOVER OR REPORT ALL SECURITY VULNERABILITIES, OR REMEDIATE ANY DETECTED VULNERABILITY, OR PREVENT ANY DETECTED VULNERABILITY FROM BEING EXPLOITED. BY USING VULNERABILITY MANAGEMENT, CUSTOMER AGREES THAT NEW RELIC WILL NOT BE LIABLE FOR ANY LOSS, INTERRUPTION, OR INJURY TO CUSTOMER’S SYSTEMS OR THE SERVICE AND ACKNOWLEDGES THAT VULNERABILITY MANAGEMENT IS NOT PROVIDING A SECURITY OR LEGAL COMPLIANCE ASSESSMENT. 


4. New Relic Generative AI

4.1. Access and Use. New Relic offers Customers generative artificial intelligence features and capabilities (“GenAI”). By enabling or using GenAI for and with your Services: (a) Customer will use GenAI as permitted and described in the Documentation and Acceptable Use Policy; (b) Customers should evaluate the accuracy of any output as appropriate for your use case, including by using human review of the output; (c) Customer Data and outputs will be used for purposes of monitoring for, and helping prevent, abusive or harmful uses or outputs; (d) Customer Data, feedback, outputs, and related information may be used to improve the GenAI, provided that improvements to the GenAI will not identify you or any individuals; (e) Customer consents to applicable Customer Data processing and storage in the United States and Europe; and (f) if Customer discovers any vulnerabilities or breaches related to your use of GenAI, Customer must promptly notify New Relic and provide details of the vulnerability or breach via the feedback mechanism provided with GenAI. Customer is responsible for responding to any third-party claims regarding Customer’s use of GenAI in compliance with applicable laws. Where practicable, New Relic will use reasonable efforts to provide prior notice before New Relic will suspend or discontinue access to and use of GenAI. NEW RELIC MAKES NO WARRANTIES CONCERNING ANY OUTPUTS OR RESULTS TO BE ACHIEVED FROM GENAI. Customers must not scrape, extract or attempt to discover or reverse engineer any underlying components of the GenAI models, algorithms, and systems.

 

5. New Relic Control

5.1. Customer may choose to enable New Relic Control. Customer controls and is responsible for its own configuration and use of the Service, including setting up and managing the integration of its Customer Properties, Third-Party Services, devices, or other systems that are provided by you or a third party and interoperate with the Services (“Non-New Relic Applications”).  This includes, but is not limited to, implementing and configuring the connections between Non-New Relic Applications and the Services.

By enabling or using the Non-New Relic Application to the Services, (i) Customer acknowledges, agrees, instructs New Relic to, and grants to New Relic the right to access, interact and interoperate with the Non-New Relic Applications in order to provide the Services, including but not limited to, enabling bidirectional communication between the Services and the Non-New Relic Applications (ii) Customer is responsible for ensuring that its use of the Services with the Non-New Relic Applications and associated Customer Data complies with the terms of the Agreement, applicable terms of Customer’s agreements with third parties, and Customer’s own policies.

 

6.  Separate Platforms

6.1. Definitions.

Separate Platform” means any platform, add-on, service or product provided by New Relic separate from the Services and that Customer elects to integrate or enable for use with the Services.

6.2. Applicability.  New Relic makes certain services available separate from the Services.  Use of these Separate Platforms, such as Community Cloud for Pixie, is subject to the terms and conditions for the Separate Platform(s) made available to you on their respective websites.  

By logging into the Separate Platform(s), you agree to the respective Separate Platform terms, which are incorporated by reference and govern your use of the Separate Platform.  Further, if Customer enables a Separate Platform with the Services, New Relic may access and exchange Customer Data with the Separate Platform on Customer’s behalf.

 

7.  New Relic Services Supplemental Terms

7.1.  Restricted Availability. Customer represents and warrants that it is not (a) an entity incorporated in Russia or Belarus, (b) an individual with a primary residence in Russia or Belarus, or (c) providing the Services to an entity or individual described in (a) or (b).  New Relic reserves the right to immediately suspend the Services and terminate the Agreement in the event of a breach of this Section.
